By using MailCraft AI ("the Service") at mailcraftapp.com, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the Service.

1. The Service

MailCraft AI is a B2B cold email personalization tool that uses artificial intelligence to help sales professionals write personalized outreach emails. The Service is operated by OrbitBuilds AI.

2. Eligibility

• You must be at least 18 years old to use the Service
• You must be using the Service for lawful business purposes
• You must provide accurate information when creating an account

3. Acceptable Use

You agree to use MailCraft AI only for legitimate, lawful cold outreach. You must NOT use the Service to:

• Send spam, unsolicited bulk emails, or harassing messages
• Violate CAN-SPAM (US), CASL (Canada), GDPR (EU), or any applicable anti-spam law
• Generate emails targeting minors
• Create phishing, fraudulent, or deceptive content
• Impersonate another person or company
• Scrape, reverse-engineer, or abuse the Service

We reserve the right to suspend accounts that violate these terms without refund.

4. Your Responsibilities for Cold Email Compliance

• CAN-SPAM Act (USA): Include your physical address, a clear opt-out mechanism, and honest subject lines
• GDPR (EU/EEA): Ensure you have a legitimate basis to contact recipients. B2B cold email may qualify under legitimate interest
• CASL (Canada): Requires express or implied consent before sending commercial emails
• PECR (UK): Similar to GDPR; B2B emails to corporate addresses are generally permitted with opt-out
• PDPA (Singapore/Thailand): Consent or legitimate interest required
• Australia Spam Act: Requires consent and an unsubscribe mechanism

OrbitBuilds AI is not liable for how you use generated emails.

5. Subscription & Payments

• Subscriptions are billed monthly via Stripe
• You may cancel at any time; access continues until the end of the billing period
• We do not offer refunds for partial months except where required by law
• Email credits reset on the 1st of each month and do not roll over
• We reserve the right to change pricing with 30 days' notice

6. AI-Generated Content

• Emails generated by the Service are AI-generated and may require editing before sending
• We do not guarantee reply rates, open rates, or any specific business outcomes
• You own the emails generated for you; we claim no rights over your output
• AI outputs may occasionally be inaccurate — always review before sending

7. Data & Privacy

Our use of your data is governed by our Privacy Policy. Key points:

• Prospect data you enter is sent to Anthropic's API to generate emails and is not permanently stored by us
• Your account data is stored securely on Cloudflare's infrastructure
• We do not sell your data to third parties

8. Intellectual Property

• The MailCraft AI platform, design, and code are owned by OrbitBuilds AI
• You may not copy, resell, or white-label the Service without written permission
• You retain full ownership of emails generated using your account

9. Service Availability

We aim for high availability but do not guarantee 100% uptime. We are not liable for losses caused by downtime, API outages (including Anthropic's), or data loss. We will make reasonable efforts to notify users of planned maintenance.

10. Limitation of Liability

To the maximum extent permitted by law, OrbitBuilds AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost revenue, lost data, or reputational harm from emails you send using our platform.

Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or abuse the Service. You may delete your account at any time by emailing support@orbitbuilds.ai.

12. Governing Law

These Terms are governed by the laws of India. For EU customers, mandatory consumer protection laws of your country of residence also apply. Disputes will first be attempted to resolve via email before any legal proceedings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email for material changes. Continued use after the effective date constitutes acceptance.
